Transaction security

 

All transaction information passed between www.onlineboilers.co.uk and the Sage Pay Systems is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to Online Boilers Ltd servers from Sage Pay are signed using MD5 hashing to prevent tampering. You can be completely secure in the knowledge that nothing passed to the Sage Pay servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.

 

Encryption and Data Storage

 

Once on the Sage Pay systems, all sensitive data is secured using the same internationally recognised 256-bit encryption standards used by, among others, the US Government. The encryption keys are held on state-of-the-art, tamper proof systems in the same family as those used to secure VeriSign's Global Root certificate, making them all but impossible to extract. The data held by Sage Pay is extremely secure and Sage Pay is regularly audited by the banks and banking authorities to ensure it remains so.

•6.    Order Acceptance

Any payment sent by the customer will represent a 100% deposit for the products detailed in the sale. Any acknowledgement, by e-mail or other means, at this time is to report that the order is being dealt with, and is not an acceptance of that order.

VAT is charged to all items purchased this website at the prevailing UK rate of 20.0%. If purchasing from abroad individual arrangements will have to be made with customs and excise over the refund of this money.

Eulinx Ltd retains the right to decline, or cancel, any orders without reason. If a deposit has been taken a full refund will be given. Eulinx Ltd may also suspend any orders until further information is gained to complete the transaction and/or delivery.

All technical specifications on Eulinx Ltd websites are approximations and further information should be gained from the manufacturers, links to which can be found in this website. Eulinx Ltd accepts no responsibility for the accuracy of information on third party websites. Eulinx Ltd, as a seller, holds no liability in the event of the goods infringing the rights of a third party. In the event of this occurrence Eulinx Ltd are obliged to transfer any such title, without prejudice, to the responsibility of the consumer for a remedy.

  • 7. Payment Terms

We will charge your account for payment upon receipt of your order. If your offer is rejected then a full refund will be made. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from your account then we can cancel the contract and or suspend any further deliveries to you. This does not affect any other rights we may have.

Payment can be made using all major credit or debit cards with the exception of American Express. 

•8.    Delivery

Our standard delivery charges are £15 per delivery on orders under £150, but may vary according to the delivery address and cannot be refunded. Orders with a value in excess of £150 will receive free delivery subject to location.

For deliveries to the Isle of Wight, the Isle of Man, the Scottish Isles, parts of Scotland, Northern Ireland and the Channel Isles you may be required to pay extra for delivery. Email us for further details.

Delivery will be using a one man delivery and will deliver to ground floor locations only.

Normal delivery schedules are Monday - Friday (excluding public holidays).

We are only able to deliver to addresses within the United Kingdom and it might not be possible for us to deliver to some locations.

We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. Any changes to your delivery address after your order has been processed for despatch may result in additional administrative charges.

When a delivery date has been arranged please ensure that you or your approved agent is available at your address to accept the delivery. Should our delivery agent arrive and there is no one available to accept delivery, unfortunately you may incur a second delivery charge. Please ensure that someone is available to accept the delivery

We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence). We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.

YOU ARE ADVISED NOT TO BOOK AN INSTALLER OR CONTRACTOR UNTIL YOUR GOODS HAVE ARRIVED AND HAVE BEEN CHECKED. EULINX LTD OR ITS AGENTS ARE NOT LIABLE FOR ANY INSTALLER OR CONTRACTOR COSTS, CONSEQUENTIAL LOSS OR COMPENSATION IN ANY WAY.

You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss, damage or destruction.

On arrival, all goods must be inspected carefully for any signs of damage to the packaging by you or your approved agent at the delivery address given at the time of placing your order. Please inspect the packaging before signing the delivery note. In the unlikely event that you do find any damage or shortage, please ask the driver to take the goods back with them and sign the delivery document as damaged.

Once the product has been removed from the original packaging and faults, damage or shortages are found the responsibility of this lies with the manufacturers in line with their standard manufacturer's warranties and not with Eulinx Ltd.

All products supplied by Eulinx Ltd have gone through rigorous testing by the manufacturers and are supplied with standard manufacturer's warranties.

Do not install your product if it is damaged, as once it is installed you have agreed to it being in good condition.

If in the unlikely event that the product is damaged or missing a part when you open the boxes or parcel. Please notify the manufacturer directly as the responsibility to supply, repair or replace damaged, missing or faulty parts is covered under the standard manufacturer's warranties. All the manufacturers used by Eulinx Ltd have a special service team which are available 24hrs a day, the details of which can be found in the installation instructions or alternatively online.

 

•9.    Returns Policy

 Cancellation

This Condition does not affect your legal and statutory rights, and further advice can be obtained from the Citizens Advice Bureau.
You will be entitled to cancel the Contract with us in the following circumstances:

Where you are unhappy with the Goods, for whatever reason, and notify us before the expiry of seven working days from the day after the day on which the Goods were received and goods remain unopened in the exact state they were delivered.

Where Goods supplied are not in accordance with the specifications of your order.
In all other circumstances, once the Goods have been received, you will not be able to cancel the Contract and will be liable to us for the price, unless otherwise determined in our absolute discretion.


Where you wish to cancel your order, we request that you return the Goods to us in accordance with our Returns policy.


Please note that this right of cancellation does not apply where Goods are specifically made to your specification or personalised at your request.
We warrant to you that the Goods will be of satisfactory quality and fit for their normally intended purpose. This warranty is given subject to the following conditions, and we shall be under no liability in respect of:

any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow our instructions (whether oral or in writing), misuse or alteration or repair of the Goods without our approval;
any attempt made by you or any third party to remedy a defect before the Goods in question have been returned to us for inspection (if so required).

Returns

Goods received and returned after the 7 day period and up to 30 days may be returned at our discretion.

Do not return Goods to us without following the steps below. We will not be liable for any Goods returned to us that do not follow this procedure.

1. You have a statutory duty to take reasonable care of the Goods whilst they are in your possession and up until the time when the Goods are physically returned to us. Notwithstanding any rights you have as a "consumer" under the Consumer Protection (Distance Selling) Regulations 2000 ("The Regulations") in relation to cancellation of an order or returning Goods to us, if any damage is caused to the Goods whilst they are in your possession, we may have a claim against you for breach of that statutory duty.

2. Before returning any Goods to us we request that you contact us in writing or by e-mail at enquiries@onlineboilers.co.uk  to inform us that Goods are being returned and to obtain a return reference number. Eulinx will then inform you of the steps that need to be taken to return goods.

3. In returning the Goods to us we request that you comply with the following requirements:
3.1. You state your original order reference number on any correspondence sent with the returned Goods to assist us in dealing with any refund efficiently;
3.2. Return the unopened products in undamaged original packaging;

4. Except where otherwise agreed, you are responsible for returning the Goods to us. We ask that you please ensure that you obtain adequate proof of delivery as we will not be liable for any Goods that are lost or damaged in transit.

5. Where Goods have been damaged whilst in your possession we shall not be obliged to accept the return of those Goods. In such circumstances, we will notify you that the Goods are available for re-collection or re-delivery for which you shall be liable for any reasonable delivery charges incurred.

6. We shall inspect all Goods that are returned and should we deem the complaint for damaged or faulty Goods to be unjustified, we will inform you of the reasons for our decision and either notify you that the Goods are ready for collection or arrange for them to be re-delivered to you.

7. Where we accept the return of the Goods, we will provide you with either replacement Goods or a full refund or account credit as you request. Any refund will be repaid or credited within 30 days of being notified of your intention to cancel.

Cancellation by us

We reserve the right to cancel the contract between us if:

We have insufficient stock to deliver the goods you have ordered;

We do not deliver to your area; or

One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order.

10. Availability

All orders are subject to acceptance and availability. If the Goods you have ordered are not available from stock or are not standard stock items, we will contact you by e-mail or phone (if you have given us details). You will have the option either to wait until the item is available from stock or to cancel your order.

11. Ordering Errors

You are able to correct errors on your order up to the point on which you click on "Proceed with Order" during the ordering process.

12. Warranty

All boilers sold are new and come complete with the manufacturer's warranty for parts and labour. Details of each warranty may vary from manufacturer to manufacturer but typically they are for at least one year. For specific details of boiler warranties and conditions contact the manufacturers directly.

Manufacturer warranties generally begin from when the boiler is commissioned, not when the boiler is purchased. Typical restrictions on the warranties are that the boiler is commissioned by a qualified professional.

13. Governing Law, Jurisdiction and Language

These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.

We do not warrant that materials/items for sale on the Website are appropriate or available for use outside the United Kingdom. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws. All contracts are concluded in English.

While we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy and completeness of the material on this Website. Moreover, where images of certain items are not available in whole or part we reserve the right to replace with similar but confirm that this does not affect your statutory rights. If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing at our contact address of the problem within 60 days of the date on which you ordered the goods (unless this is not reasonably practicable). If you notify a problem to us under this condition, our only obligation will be, at your option:

  •  
    • To make good any shortage or non-delivery;
    • To replace or repair any goods that are damaged or defective; or
    • To refund to you the amount paid by you for the goods in question in whatever way we choose.

Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract. Neither party shall have any liability to the other party for a claim of loss of profits.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Notwithstanding the foregoing, nothing in these terms and conditions affects your statutory rights.

16. Third Party Rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

17. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
